By accessing the Site, making a reservation, staying at the property, or purchasing any service or product, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Site and services.

All descriptions, images, and amenities are representative only and may vary by season, availability, weather, or maintenance needs. No guarantee is made that every feature shown or described will be available at all times.
3. Reservations, Payments & Cancellations

Refund eligibility
are disclosed at the time of booking and are incorporated into these Terms by reference.
Failure to comply with reservation terms may result in forfeiture of deposits or full charges.
4. Guest Conduct, Quiet Enjoyment & Property Rules
Guests agree to:
Respect quiet hours and posted house rules
Treat the property, furnishings, and grounds with care
Comply with all local, state, and federal laws
We reserve the right to:
Refuse service
Terminate a stay without refund
Charge for damage, excessive cleaning, or rule violations
No tenancy or landlord-tenant relationship is created by a stay at The Edenwild.
5. Assumption of Risk (Washington-Specific)
The Edenwild is located in a rural island environment. By staying at or visiting the property, you acknowledge and voluntarily assume all risks associated with:
Uneven terrain, stairs, docks, and walkways
Weather conditions and power interruptions
Wildlife and natural surroundings
Bicycles, water access, and outdoor amenities
Limited emergency response times typical of island communities
To the fullest extent permitted by Washington law, you voluntarily assume all known and unknown risks associated with your stay, except where caused by our gross negligence or willful misconduct.
6. Recreational Use Disclaimer (RCW 4.24.210)
Use of recreational areas and amenities—including grounds, docks, walkways, bicycles, or water access—is voluntary and unsupervised.
To the extent applicable, The Edenwild asserts protections under Washington’s Recreational Use Statute (RCW 4.24.210).
7. Guest Property & Innkeeper Liability (RCW 19.48)
Guests are solely responsible for their personal property.
To the fullest extent permitted by Washington law:
The Edenwild is not responsible for loss, theft, or damage to guest property
Guests are encouraged to secure valuables
Liability is limited as permitted under Washington innkeeper statutes
Parking & Vehicles
On-site parking is provided for guest convenience only. Parking areas are open and unsupervised.
Guests park vehicles at their own risk. The Edenwild is not responsible for loss, theft, vandalism, weather-related damage, or damage caused by other guests, wildlife, falling branches, uneven surfaces, or natural conditions.
Parking does not create a custodial or bailment relationship for vehicles or personal property. Guests are responsible for securing vehicles and belongings at all times.
Personal Equipment & Belongings
Guests are responsible for the safe use, storage, and supervision of personal equipment brought onto the property, including bicycles, watercraft, strollers, carriers, or other gear. The Edenwild is not responsible for damage to or injury arising from the use of personal equipment.
8. Minors & Parental Responsibility
Parents or legal guardians are fully responsible for:
The supervision, safety, and conduct of minors
Any damages caused by minors
Compliance with property rules
9. Website Use & Intellectual Property
All content on the Site—including photographs, text, logos, branding, and design—is the exclusive property of The Edenwild and protected by intellectual property laws.
You may not copy, reproduce, distribute, or use content without prior written permission.

12. Force Majeure (Island-Specific)
The Edenwild shall not be liable for delays, cancellations, interruptions, or inability to perform due to events beyond our control, including but not limited to:

Power or utility outages
Severe weather or natural disasters
Wildfires, earthquakes, or floods
Government orders, emergencies, or public health events
No refunds are required for force majeure events unless expressly stated in your reservation policy.
13. Disclaimer of Warranties
To the fullest extent permitted by law, all services, accommodations, and Site content are provided “AS IS” and “AS AVAILABLE.”
We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and uninterrupted service.
14. Limitation of Liability (Washington-Compliant)
To the fullest extent permitted by Washington law:
The Edenwild shall not be liable for indirect, incidental, consequential, special, or punitive damages
Total liability, if any, shall not exceed the amount paid for the stay or service giving rise to the claim
Emotional distress, loss of enjoyment, and travel inconvenience damages are expressly excluded
15. Indemnification
You agree to indemnify and hold harmless The Edenwild, its owners, employees, and agents from any claims, losses, damages, or expenses (including attorney’s fees) arising from:
Your stay or use of the property
Your violation of these Terms
Your actions or omissions
16. Attorney Fees
In any dispute arising out of these Terms or your stay, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs, as permitted under Washington law.
17. Termination of Access
We reserve the right to terminate access to the Site or services at any time, for any reason, without notice.
18. Governing Law & Venue
These Terms are governed by the laws of the State of Washington.
Any legal action shall be brought exclusively in San Juan County, Washington, unless otherwise required by law.
19. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy and reservation policies, constitute the entire agreement between you and The Edenwild.
21. Changes to Terms

22. Accessibility & Accommodation Notice
The Edenwild is a small, independently operated boutique inn located in an older building. Room layouts, access paths, and amenities vary by room and may not meet every guest’s individual accessibility, sensory, or accommodation needs.
We are committed to complying with applicable disability laws and to providing reasonable accommodations when requested. Termination/access restriction

To the maximum extent permitted by law, this agreement is governed by the laws of the State of Washington and you hereby consent to the exclusive jurisdiction and venue of courts in Washington in all disputes arising out of or relating to the use of the Site. You agree that no joint venture, partnership, employment, or agency relationship exists between you and TE as a result of this agreement or use of the Site. TE’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of TE’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by TE with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and TE with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and TE with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent an d subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
